This exclusivity empowers inventors to prevent others from making, using, selling, or distributing their inventions without permission. Patents serve as a powerful tool to incentivize innovation by providing inventors with a competitive edge and the opportunity to recoup their investment in research, design, and development.

Now, why do you need a patent? To protect your inventions and ideas. In today’s copy-paste mindset creators have the upper hand and ideas are valuable currency. Without a patent, your innovative concepts and designs are at risk of being exploited or copied by competitors. We’re seeing this happen more and more over the past few years with the boom in online e-commerce sales and international imports here in the US. Despite having a patent and patent significance, there are several myths surrounding patents, clouding their true purpose and benefits.

Common Patent Misconceptions

• Patents are only for large corporations: This couldn’t be farther from the truth. Patents are available to anyone with an inventive concept, irrespective of their size or resources. Patents can be particularly beneficial for small businesses and individual inventors, providing them with a level playing field and opportunities for growth and expansion.

• Patents snuff innovation: Wrong! Patents stimulate innovation by rewarding inventors for their ingenuity and investment in research and development. The exclusivity granted by patents incentivizes inventors to disclose their inventions to the public, fostering collaboration, and driving further innovation. Moreover, patents encourage competition by allowing inventors to build upon existing ideas without fear of infringement, thus fueling technological progress. This is one reason design patents are just as valuable and as innovative as utility patents.

• Patents are too expensive and time-consuming: Myth! While a patent can involve some costs and time, they are an investment in the long run. Think, chess not checkers. With proper guidance and strategic planning, even asking for a payment plan, you can afford to file for your patent sooner than you think. And the sooner the better.  The benefits of owning your IP far outweigh the cost of initial investment to file.

• Patents guarantee commercial success: Absolutely not! Yes, patents confer exclusive rights to the inventor, but they do not guarantee automatic commercial success. You still have to do the work, build a network, and have a clear business model that works to gain commercial success. This is the hardest part – putting it all together. Does having a patent behind your brand and product look more ideal to investors and potential consumers? Yes, it does, but commercial success isn’t guaranteed.
